How to find assets your spouse may be hiding in divorce

Divorce is a difficult and complex process, especially when it comes to finances. Money-related issues are some of the most hotly contested matters in Illinois divorces, and it may be impossible for the two spouses to come to a reasonable agreement out of court. If you are facing the prospect of a contentious divorce, you may be wondering how you can protect your financial interests.

In some high asset and highly contentious divorces, one spouse may attempt to hide assets from the other. By moving money around, selling off valuable assets and keeping the cash, and doing other things to hide money, it can ultimately affect your final divorce order. It is in your interests to know how to find hidden assets and pursue a fair property division settlement.

Playing hide and seek

If you suspect that your spouse is hiding assets, you may think there is nothing you can do to fight back and protect your interests. The moment you suspect that your spouse could be trying to keep you from your rightful share of marital property, you can take action to find those assets and fight for your portion of it. Some of the steps you can take include the following:

  • The first step is to carefully examine all voluntary disclosures your spouse made. In a divorce, spouses must provide each other with appropriate financial information. Looking at these disclosures carefully can reveal if there are any problems.
  • If you need more information, you can demand that your spouse give you the information you need through an involuntary disclosure. With these types of disclosures, your soon-to-be ex-spouse has a legal obligation to tell you want you need to know.
  • If additional action is necessary, you may be able to move to have your spouse deposed. Your spouse would then have to answer questions under oath. You can use these answers in court at a later date.

Hidden assets are a complex issue in a divorce. If your financial future is on the line, you would be wise to take the steps necessary to get the information you need to fight for the full amount you deserve.

You do not have to navigate these complex issues on your own. Before you move forward, you may want to discuss your concerns with an Illinois family law attorney experienced in these complex types of divorce issues. With the right help, you can fight for the secure post-divorce future you deserve.
